In Poland, disciplinary judiciary in public trust professions has low level of transparency, while it is the disciplinary judiciary that defines conditions for performing many important professions, and thus for proper functioning of the society as a whole. The lack of transparent disciplinary judiciary procedures creates the sense of legal uncertainty and leads to undermining of the public trust.
The aim of the project was to improve the level of transparency of disciplinary judiciary and to enhance the awareness among professional self-government bodies on the issues of openness of the disciplinary proceedings.
Under the project, verdicts of disciplinary courts of justice for ten selected public trust professions were analysed.
Under the project, over 500 applications for access to public information were filed and about 150 court cases were conducted that confirmed the obligation of disciplinary judiciary bodies to present information on disciplinary proceedings. The bodies covered by the monitoring were asked about the number of proceedings conducted and their results, and the members and volunteers of the Association participated in disciplinary court proceedings and analysed Internet pages of organisations of persons performing selected professions and their professional periodicals. Ten legal analyses were prepared on disciplinary regulations for selected professions. Over 800 disciplinary verdicts were disclosed and made available on the Internet page launched under the project (monitoringdyscyplinarny.pl). A 152-page publication was also prepared to sum up the project, presenting ten analyses on the state of disciplinary judiciary in selected professions. The project recipients were supplied with recommendations for amendments in their internal disciplinary regulations and relevant acts of law and proposals for changes in the practical functioning of their disciplinary bodies.
The project benefited representatives of public trust professions and recipients of their services.
